Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of the Terms of Service and applies to all users of Theta One AI's APIs, Console, and related services (the "Service"). You are responsible for your own use and for the use of any application that calls our API with your API key.

Violation of this AUP is a material breach and may result in immediate suspension or termination without refund.

1. Prohibited content and activities

You may not use the Service, or allow others to use it, to generate, process, transmit, or store content that:

  1. Is illegal in any applicable jurisdiction, including content that infringes intellectual-property rights, violates export-control or sanctions laws, or facilitates criminal activity.
  2. Sexually exploits or endangers minors — including child sexual abuse material (CSAM), grooming, or any processing of audio that depicts sexual activity involving a minor. We report suspected CSAM to the appropriate authority (in Korea, the National Police Agency; in the US, NCMEC).
  3. Harasses, threatens, defames, or incites violence against any person or group.
  4. Engages in unlawful discrimination on the basis of race, ethnicity, religion, disability, gender, sexual orientation, age, or other protected characteristics.
  5. Impersonates another person (including voice cloning for impersonation, fraud, or deception).
  6. Violates privacy — submits audio or text containing someone's voice or personal information without the consents required by applicable law.
  7. Is intended to deceive — e.g., deepfake voices used to mislead voters, defraud, or manipulate markets.
  8. Contains malware, phishing content, or is part of a spam campaign.

2. Prohibited use cases

You may not use the Service, by default, for:

  • Biometric identification of individuals by voice;
  • Emotion recognition for employment, insurance, education, or law-enforcement decisions;
  • Mass surveillance (including workplace monitoring without lawful basis);
  • Medical diagnosis or treatment decisions;
  • Credit, housing, employment, or insurance eligibility decisions;
  • Law-enforcement predictive decisions about individuals.

3. Technical abuse

You may not:

  1. Reverse-engineer, decompile, or attempt to discover the source code of the Service, except to the extent mandatory law allows;
  2. Circumvent authentication, rate limits, or billing (including sharing API keys across organizations or obscuring request origin to evade limits);
  3. Probe, scan, or test the vulnerability of the Service without a written bug-bounty authorization;
  4. Interfere with other users' access or with the integrity of the Service (DoS, load testing without written approval, resource exhaustion);
  5. Scrape, mirror, or mass-download the Service's documentation or responses in a manner that exceeds ordinary use;
  6. Use the Service to train a machine-learning model that competes with Theta One's services, or for benchmarking against Theta One's services for public comparison without prior written consent.

4. End-user responsibility

If your application submits audio from end users, you must:

  • Disclose in your own privacy notice that audio may be transmitted to a third-party STT/pronunciation provider (Theta One);
  • Obtain any consent required by applicable law (e.g., parental consent for minors under PIPA, GDPR, COPPA);
  • Offer end users a way to decline voice processing;
  • Avoid sending sensitive categories of data (health, biometric identification, religious beliefs) unless you have a lawful basis documented in writing.

5. Reporting abuse

To report a violation of this AUP — including apparent CSAM, harassment, or fraud — contact abuse@thetaone.co immediately. For CSAM, we cooperate with law enforcement.

6. Enforcement

We may, at our discretion:

  • Warn the account holder;
  • Throttle or suspend specific API keys;
  • Suspend or terminate the account;
  • Preserve evidence and disclose to law enforcement when required by law or when life, bodily safety, or a minor's safety is at risk.

We are not obligated to monitor all activity, but we may investigate suspected violations and take any action permitted by law or by the Terms.
